Tigerfish Foils Ltd Warranty

This Tigerfish Foils Ltd Warranty (“Warranty”) is a voluntary manufacturer’s warranty by Tigerfish Foils Ltd, a New Zealand company (company number 9247722) (“Tigerfish Foils”). This Warranty applies to the products listed below. Your legal rights as a purchaser may vary by country or jurisdiction. This Warranty does not affect these rights.

1. Important Information

Before using the product, please read all Manta5’s “Product Materials,” including but not limited to:

  • User manuals
  • Safety guidelines
  • Specifications
  • Training videos
  • Social media posts
  • Service communications from Manta5 or its authorised representatives

Warranty Registration: Manta5 product warranty registration must be completed upon purchase through the required monthly warranty reporting.

2. Warranty Coverage

Manta5 warrants that for the relevant coverage periods, the Hydrofoiler will be free from defects in material and workmanship under normal use in accordance with Manta5’s Product Materials.

Warranty Periods:

  • 1-Year Warranty on Manta5 Hydrofoiler:
    • Chassis
    • Foils (front and rear)
    • Motors
    • Gearboxes
  • Manta5 Hydrofoiler Batteries: 1-year warranty or up to 250 charge cycles, whichever occurs first.

3. Warranty Claim Requirements

  • Proof of original retail purchase must be presented when making a claim.
  • If the product is no longer owned by the original purchaser, the remaining warranty period (if any) is transferable to a second owner, provided proof of original retail purchase is presented.

4. Warranty Exclusions

This Warranty is void under the following circumstances:

  1. Improper use of the Hydrofoiler, including excessive or abnormal use.
  2. Crash, physical impact, collisions, or fire resulting from non-manufacturing processes or unsafe conditions.
  3. Damage caused during transport, loading, unloading, dropping, or inappropriate storage, including exposure to temperatures outside those stated in the Product Materials.
  4. Modification of the product without Tigerfish Foils’ approval.
  5. Improper maintenance or servicing, including non-compliance with Product Materials.
  6. Wear and tear, including parts like seals, oil, bearings, and scratches from normal use.
  7. Damage to composite parts (foils, chassis) caused by prolonged exposure to direct sunlight or high temperatures.
  8. Commercial use of any kind.
  9. Removal or defacement of the serial number.
  10. Colour matching of replacement parts.
  11. Software programs or data loss.
  12. Use for purposes other than personal use.

5. Consumer Protection and Legal Rights

  • The Products are intended for personal use.
  • In addition to the Product Warranty, applicable consumer guarantees under New Zealand’s Consumer Guarantees Act 1993 (if applicable) and other consumer protection laws also apply.
  • Where a failure breaches applicable consumer guarantees, Tigerfish Foils will repair, replace, or refund the product as required by law.

6. Business Purchases

If Products are purchased for business purposes:

  1. The Product Warranty does not apply.
  2. Consumer protection laws, including the New Zealand Consumer Guarantees Act 1993, do not apply.
  3. These terms, including this clause, are fair and reasonable.

7. Warranty Claims and Support

If you believe your product does not meet the Warranty or consumer protection laws, or if you received the wrong product, contact us at contact@manta5.com. Tigerfish Foils will guide you through the process of:

  1. Determining if the product is defective.
  2. Returning the product.
  3. Providing the appropriate remedy.

8. Inspection and Servicing Costs

If inspection or servicing reveals no legitimate warranty claim, you will bear the cost of such services.

9. Compliance with Local Laws

Tigerfish Foils makes no representation that the Products, their purchase, or use are legal in all countries. It is your responsibility to ensure compliance with local laws regarding purchase, importation, and use.
